STARTKEY TERMS OF SERVICE AND USAGE AGREEMENT
1. PARTIES
1.1. Service Provider: Startkey is a company operating in the real estate sector through its website www.startkey.com.tr, offering franchise services.
1.2. Service User: The Service User is an individual or legal entity applying to benefit from Startkey's franchise services.
2. SUBJECT
This agreement regulates the services provided by Startkey to the Service User and the conditions of these services. It is the document governing the provision of franchise services by Startkey. Both parties declare, accept, and commit to the accuracy of the information provided herein.
3. SERVICES
3.1. Startkey commits to providing franchise services in the real estate sector to the Service User.
3.2. The franchise services offered are carried out under the conditions and programs determined by Startkey.
3.3. The Service User has the right to use the services offered by Startkey and agrees to comply with the stipulated rules while benefiting from these services.
3.4. The Service User agrees, declares, and commits to the use of the information specified on the www.startkey.com.tr page by Startkey.
4. RIGHTS AND RESPONSIBILITIES OF THE PARTIES
4.1. Startkey is responsible for ensuring the quality and accuracy of the franchise services provided.
4.2. The Service User commits to act in accordance with the rules and operations set by Startkey.
5. PRICING AND PAYMENT TERMS
5.1. The cost and payment terms of the franchise services will be determined separately between the parties and arranged as an annex to this agreement. Startkey reserves the right to change the fees and tariffs unilaterally and prospectively without prior notice.
6. CONFIDENTIALITY
6.1. The parties agree to protect and not disclose the confidential information obtained within the scope of the agreement to third parties.
7. TERMINATION AND CANCELLATION
7.1. The parties have the right to terminate the agreement mutually or for legal reasons. Startkey reserves the right to unilaterally terminate the agreement without any notice or warning if the Service User fails to fulfill the responsibilities and commitments outlined in this agreement.
8. DISPUTE RESOLUTION
8.1. In case of disputes between the parties, the courts and enforcement offices in Izmir have jurisdiction.
9. ENFORCEMENT
This agreement enters into force upon signing by both parties and is binding regarding the rights and obligations of the parties.
10. CHANGES AND ADDRESSES
This agreement may be modified or updated with the mutual written consent of the parties.
10.1. The parties declare and commit that any notifications related to this agreement will be sent to the postal addresses specified on www.startkey.com.tr as their legal domicile.
10.2. Any notifications sent to these addresses will be deemed delivered even if they do not reach the parties. Unless changes to these addresses are communicated in writing to the other party, the old addresses will remain valid.
10.3. Startkey may send messages, information, notices, warnings, payment notifications, account activity charts, or account statements to the email address assigned to the Service User during the agreement term. The Service User declares, accepts, and commits not to claim that such electronic communications were not received or did not reach them and agrees that such communications will be deemed delivered seven days after being sent.
10.4. Validity of Startkey Records: The Service User agrees, declares, and commits that, in case of disputes arising from this agreement, Startkey's ledger records, computer records, emails, and other communications stored on Startkey's servers will constitute valid, binding, conclusive, and priority evidence under Article 287 of the Turkish Code of Civil Procedure. The Service User waives in advance the right to object or propose an oath regarding the validity of these records.
